*[All council members were present, as were Clerk-Treasurer Carol Zeman, Engineer Steve Schreiber & Solicitor Russ Pry. In the absence of Mayor Ray McFall, Councilor Bill Goncy (President Pro-Tempore) presided.]
*[Council President Pro-Tempore Bill Goncy announced that he would preside in the absence of Mayor Ray McFall, who was away at his Navy Ship Reunion (USS Skagit). Councilor Jim Hudson was elected temporary President Pro-Tempore. His duties turned out to be light.]
*[C-T Carol Zeman read a letter from Mayor McFall
stating that the controversial Army Reserve Center
would not be built in the village after all.]
*[Ms. Zeman also read a letter from Fire Chief Jim Robinson nominating Roger Robinson (brothers?)
for appointment as Assistant Chief.]
*[Councilor Goncy read a letter from Akron Metro Regional Transit Authority
noting that Boston Heights was currently served by a bus route, and advertising
public meetings on 16-18 September 2003
to consider mass transit service changes.]
*[Two ladies residing on Brandywine Road asked a series of questions about the recent
repair work carried out on that road:
... What was the cost of the chip & seal coating? Engineer Steve Schreiber replied that
the contract price for that road work was $30,059. He noted that the total project
(including other roads) was under budget, however.
... Will there be more work done to complete the job, e.g. poor painting? The Engineer said
he would add that to the punch list of things for the contractor to follow up -- the job was completed
but not yet accepted pending final inspections.
... Why the decision to merely chip & seal? Engineer Steve Schrieber noted that there
were also some structural repairs completed, but that this was the most economical approach
for this road. Councilor Goncy asked whether Brandywine Road had ever really been
asphalt-paved; Engineer Schreiber didn't think so, except for tar build-up over time.
... Can the police provide better speed enforcement, as stones are being thrown about?
Mr. Goncy said he would relay this request to the police chief.
In summary: these citizens stated that they were not happy with the nature of these repairs.
Engineer Schreiber replied that, while this was sufficient for a few years, eventually more
extensive (and expensive) work would need to be done on Brandywine Road.]
*[One of these same citizens asked whether the proposed income tax increase was "still
on the ballot" for the November election. Answer was: yes, it is.
(See Ordinance 13-2003,
and last month's debate on this increase of 1/2%.)
*[This citizen also asked whether Councilors Teri Slane and Bill Goncy, as candidates for
Mayor in November, might give a statement of their campaign positions. Solicitor Russ Pry
suggested that an official Council meeting was not the proper venue for stump speeches, and
that the candidates would be glad to speak after the meeting. And... they were.]

A RESOLUTION APPROVING THE QUOTE OF LYTLE CONTRUCTION INC. FOR ROAD REPAIR WORK TO BEVERLY, GRANDVIEW, RICHARD, SHOLLE AND WOLCOTT. [Engineer Steve Schreiber noted that the quote was for $12,140, for chip & seal only, no repairs. It was pointed out that this was a quote, not a bid, since it was under the $15K threshold for mandated bidding.] |

A RESOLUTION TO ADOPT THE SOLID WASTE MANAGEMENT PLAN FOR THE SUMMIT/AKRON SOLID WASTE MANAGEMENT AUTHORITY. [In response to a question from the audience, Solicitor Pry stated that this was to bring the village into compliance with the state mandate for a trash disposal plan For info on this Authority and its plan, click: Summit/Akron Solid Waste Management Authority.] |
*[Councilor Mike Cheung stated that he had reviewed the village's financial statements through 31 August 2003.]
*[Councilor Cheung also reported on the Planning Commission
and Board of Zoning Appeals meeting of 3 September 2003, noting especially the
"continuing discussion" of a
commercial development proposed by Omni Realty
for Hines Hill Road and Boston Mills Road, east of Route 8. He noted that the next meeting would
be on 1 October 2003. Solictor Pry added that he had not yet received the proposed zoning ordinances
promised by Omni at that meeting (which would allow high-density housing in a PUD).]
*[Clerk-Treasure Carol Zeman stated that the village had applied for a $210,000 3-year loan
for the just-completed road repairs, leaving a balance of $80-85,000 in the road fund for
other future repairs -- e.g. in the Ledges development.]
*[Engineer Steve Schreiber reported...
... Karvo Paving had completed the road repairs to
Olde 8, Brandywine and Boston Mills Road, pending final inspection and acceptance by the
village. He added that Karvo would be responsible for crack-sealing within the next year.
Councilor Bill Goncy pointed out that some cleanup and berm repairs were required along Olde 8 Road.
... Work was continuing on alleviation of future flooding along W. Hines Hill Road and
in the Wooded View subdivision. (See last month's meeting
for more on this.) He reported that a storm sewer outlet had been found to be on the property
line between the Canale and Zak properties, and that the route of the line itself was still in question.
More work was needed to prepare for the proposed easement for drainage across the Canale property.
... Karvo Paving had not yet begun work on the Colesbrooke Road
repairs, and that he was expecting a work schedule from the company. He also pointed out that
he had received only two work agreements, so far, from residents in the work area. His inspectors
would be re-visiting the cul-de-sac area to see if they could more closely delineate the work areas required.
... Developers of the Liberty Harley-Davidson development
had not yet supplied acceptable engineering drawings for their
newly-moved roadway, nor for their
utility tie-ins at Hines Hill Road. Councilor Goncy pointed out that extensive work had already
been done on the new roadway. Mr. Schreiber replied that that was fine on the private property,
but that no tie-in to the public right-of-way was permitted until he had given engineering approval
to the final design.
... Final plans for the Annabelle Lake and
Donley Farm housing developments were nearing completion,
but that both were pending required further documentation.]
*[Councilor Jim Hudson reported, from Road Supervisor Jim Robinson, that the Road Department
had performed the usual maintenance on the cemetery, park and village facilities.]
*[Councilor Teri Slane stated that she had reviewed the Village's expenditures through August 2003.]
*[Council P-PT Bill Goncy stated that he had reviewed the Mayor's Court reconciliation for
July 2003, and the Village's bank reconciliations through August 2003.]
*[Engineer Steve Schreiber stated that the Village Hall's new handicap-accessible bathroom project
was almost closed out, but that some roof repairs on the addition were still required.]
*[Councilor Annette Miller asked about the status of the closed hotel on Hines Hill Road,
with regard to recent discussion on condemning that derelict structure. (See also
a note on the January 2002 Council Meeting).
Solicitor Russ Pry reported that, at the recent
Planning Commission meeting, Omni Realty had stated that they were still pursuing
quotations for asbestos and mold abatement in advance of demolition. He
added that he had requested documentation on this to ensure that it was not just a delaying maneuver.]
*[In the absence of Mayor McFall, Council P-T Bill Goncy confirmed the appointment
of Roger Robinson as Assistant Fire Chief. Mr. Robinson was not present to receive any plaudits.]
*[C-T Carol Zeman stated that Ms. Joleen Persichini had been appointed to the
"Income Tax Committee Review Board", replacing her husband Joe Persichini.
Mrs. Zeman explained that this board meets (rarely) to consider appeals and penalties relating
to enforcement of the village's income tax. The board consists of Mayor Ray McFall, sitting
as its chairman, and two citizens -- Ms. Persichini and Mr. Robert Riedel. The board
is advised by Ms. Zeman in her role of Tax Administrator for the Village. The board's
meetings are not public -- not subject to Ohio's Open Meetings law.
(Ed. Note: Village Codified Ordinance 183.11,
which establishes this board under the mandate of ORC 718.11, states that the board members
are "appointed by the Mayor with the approval of Council". Council took no such
action at this meeting -- a point that has come up with appointments to the (separate)
Tax Incentive Review Council, and required later correction: see Resolution 19-2002.]
