Anthony DeNigris
Proposal for commercial building on Chittenden Road.
Mr. DeNigris is the owner of a 4.13 acres B-1 Business parcel, #1300214. This parcel may become Light Industrial under the proposed rezoning plan.
See also the presentation at the 02-Oct-2002 meeting. Mr. Mike Scaravelli presented a preliminary plan for development of a garden center and nursery, with bulk supply storage and sales. He and Mr. DeNigris wished to review possible zoning conflicts early in the process, specifically: minimum acreage, minimum frontage, open storage restrictions. Mr. Codrea (BZA Chair) pointed out that minimum acreage was not a problem: 1A under B-1, 2A under LM. Frontage requirement of 200ft would require a variance both at the street and at the building line (about 180ft); there was a discussion of frontage variance precedents. There was a discussion of the meaning and impacts of open storage, and of road load limits. A neighbor, Mr. Thomas of Thomas Electric, made a few remarks about road impacts.

Baxter Incorporated LLC
Application for lot split at 478 E. Boston Mills Road.
Baxter Inc. LLC is owner of 478 E. Boston Mills Road, a 9.77A Residential lot, parcel #1300020. (This was formerly the late Wally & Donna Boer's place.) Mr. Baxter proposes a front-and-back split of this lot, with 2A in front and the balance at the rear, with a 50ft access easement. Village Engineer Steve Schreiber stated that Mr. Baxter's plan had been reviewed and met the requirements of the Donnelly Initiative (a 1970s-era initiative that permits so-called flag lots), and other site requirements. Mr. Schreiber therefore stated that the lot split was granted as a matter of course, without Planning Commission action.

Lot split granted by Village Engineer.

Marous Bros. - Omni Realty - Liberty Harley Davidson
Request for Approval of Final Building and Site Plans.

A representative of Marous Brothers Construction Inc. addressed the Planning Commission on Omni Development's planned Liberty Harley-Davidson motorcycle dealership on the 7.64 acres on Hines Hill Road just east of the closed motel.
He presented a revised plan that removed the mezzanine level, reduced the building footprint, and reoriented the building and parking on the lot. The Planning Commission reviewed aspects of the new plan with the Village Engineer.
Resolution:
Planning Commission approved final building plan and site plan.

Proposed Tree Protection Ordinance
See the Village's tree cutting moratorium.
Per the Dr. Cheung's proposal last month, the PC and BZA met as an advisory committee to consider tree protection ordinances in view of the recent clear-cutting activity at Boston Mills and at Hines Hill. Mayor McFall mentioned that Omni Realty has apparently arranged to purchase both properties (the Alnola Farms area, north and south of the Turnpike). There was a wide-ranging discussion of the nature of public purposes in regulating or banning tree cutting, whether commercial logging or residential maintenance. The specifics of the Walton Hills ordinance (a favorite of several members) were discussed, with some suggesting that it was too restrictive. The group discussed how reasonable regulation could be framed within requirements for other site development plans, and landscaping & buffering requirements.

Further discussion, with a special meeting planned for 19-Mar-2002 7PM.
