Omni Realty - Liberty Harley-Davidson - Marous Bros. Construction
Request for variance.

See also the 07-Aug meeting, where the BZA granted a
conditional use for this use of the property, and the 04-Sep meeting,
where the Planning Commission approved the site plan and
preliminary building plan, except for the proposed non-masonary material.
As originally proposed, the building had a glass and metal-panel sheath not conformant
with the Ordinance 1171.14 requirement for
masonary facing on such building. Omni/Marous was seeking a materials variance.
Resolution:
After extensive discussion and examination of material samples, the variance was granted
on a unanimous vote of the Board of Zoning Appeals.
The variance was narrowly drawn to specify manufacturer's product, colors, and a minimum
thickness of 20GA (approx. 0.0375in.).

Brian Feeley - Architect for Ledgewood Girl Scout Camp
The Camp Ledgewood Girl Scout camp at 7047 Akron-Peninsula Road is a tax-exempt 240 acre parcel,
#1200201.
Though within the boundaries of the Cuyahoga Valley National Park, the owner of record is
the Western Reserve Girl Scout Council. Mr. Feeley presented a building design and site plan for a new pool house, replacing an
existing structure built in 1970.
Resolution:
The building and site plan was approved on a unanimous vote of the Planning Commission.

Anthony DeNigris
Proposal for commercial building on Chittenden Road.
Mr. DeNigris is the owner of a 4.13 acres B-1 Business parcel,
#1300214.
He presented a building design and site plan for a commercial building on that parcel.
Zoning Inspector Ron Fenn stated that he must talk to the EPA about the necessary septic system,
and must talk to the Village Engineer about possible wetlands/drainage issues before
undertaking any substantial land clearing.
Resolution:
No action, pending further developments.

Further consideration of suggested changes to proposed zoning ordinances.
This continues, and perhaps completes, the discussions of the
marathon 04-Sep meeting, where amendments to
the proposed zoning plan were considered.
At the suggestion of Mr. John Codrea, the matter had been "tabled" to allow
time for the proposed ordinance to be better codified.
Of principal interest is the reversal of three zoning map changes that occurred at
last month's meeting. On a motion by Mr. David Himes, and a 3-2 vote of the combined
PC/BZA, all the parcels on the west side of Olde 8 were proposed to become RESidential.
New zoning parcel changes include:
- B-1 parcel(s) across from substation near Olde 8 and Rt.303 to become RES rather than GB
- B-1 parcel at 7720 Olde 8 (Rainbowers) to become RES rather than GB
- I-1 parcel at 7600 Olde 8 (ex-Lucerne) to become RES rather than GB
Mr. Codrea did in fact re-codify the proposed ordinance. Numbering indicated below is therefore
uncertain. Proposed amendments include (aside from typographical corrections):
- On the advice of the Village Engineer, 1151.04 reference to buffers being measured from
the center of the "roadway" were changed to refer to the "right-of-way".
- On a motion by Mr. Codrea, 1151.04 buffers will not be permitted to have open storage.
- On the advice of the Village Engineer, 1153.06 will codify the current village practice
on requirement for lot frontage in cul-de-sacs (based on Summit County requirements).
- On the advice of the Mrs. Maryann Bode, 1153.01(d) will include language referring
to the village's CO 715 temporary sign ordinance.
- At the instigation of Mr. Kris Lightcap, from the audience, adapting language suggested
by Mr. Bill Hinkle, and upon a motion by Dr. Mike Cheung, the Office/Professional zoning
district chapter will include language defining and restricting conditional and accessory
uses.
Other discussions resulted in no immediate action. These included: an inquiry by the Mayor as
to the 5000-foot spacing limitation on service stations; Dr. Cheung pointed out that this
restriction was in the current zoning code, and was not a new change. A short discussion
of lighting restrictions elicited Dr. Cheung's suggestion that the matter, while important,
should be taken up separately at another time. Finally, owners of some of the B-1 property
to be rezoned to RES made vehement objections to the proposed change.
