Minutes of the December 2004 meeting were approved.

CORRESPONDENCE

AUDIENCE PARTICIPATION

Bill Hinkle, of Boston Mills Road, asked whether Ordinance D-2005, below, was enacting changes required by Ohio House Bill 95, and if so whether those changes to the Village Income Tax were all retroactive to the 2004 tax year. Solicitor Russ Pry said "yes" and "yes"; the changes were in response to recommendations received from the Regional Income Tax Agency.


Nick Kostandaras (D-1), newly-elected County Council representative for District 1, reiterated his plan to hold periodic meetings in his District 1, Northern Summit County. He welcomes communication with his constituents.


An informal inquiry before the meeting found that further action on trash pickup would be delayed until the February 2005 meeting, presumably to allow for creation of hauler licensing regulations. See last month's New Business. At the previous Council Finance Committee meeting, discussions between Council and the low bidder (BFI) seemed to be leading to the Village giving exclusive trash hauling rights to a single hauler.

ORDINANCE A-2005

[Adopted as Ordinance 1-2005]

AN ORDINANCE APPROVING THE TEMPORARY ANNUAL APPROPRIATIONS FOR THE VILLAGE OF BOSTON HEIGHTS FOR THE YEAR 2005 AND DECLARING AN EMERGENCY.

Here are the temporary appropriations for 2005:

  • General Fund: $265,000
  • Street Construction/Maintenance/Repair: $19,000
  • State Highway: $4,100
  • Park Fund: $6,000
  • Road Levy: $45,000
  • Fire Levy: $35,000
  • Computer Fund: $6,000
  • Capital Projects: $18,000
  • Refundable Performance Bond: $14,000
  • Law Enforcement Trust: $1,550
  • Cemetery Trust Fund: $0

ORDINANCE B-2005

[Adopted as Ordinance 2-2005]

AN ORDINANCE VERIFYING AND RATIFYING ALL ORDINANCES PASSED BY THE COUNCIL FOR THE VILLAGE OF BOSTON HEIGHTS DURING THE CALENDAR YEAR 2004, AND DECLARING AN EMERGENCY.

And so we bid a fond farewell to A.D. 2004...

ORDINANCE C-2005

[Adopted as Ordinance 3-2005]

AN ORDINANCE ADOPTING A NEW CHAPTER 1179 ENTITLED "SIGNS" AS A PART OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS, AND DECLARING AN EMERGENCY.

These new comprehensive sign regulations PDF were recommended to Council by the Village's Planning Commission at its December 2004 meeting.

This council meeting had been preceded by a Public Hearing on these sign regulations. Despite the usual public postings, only two members of the public attended, both members of the Village's Board of Zoning Appeals. Councilor Bill Goncy passed along to Council the comments of BZA Chairman William Hinkle: the new regulations sharply limit the size of permitted signs; where it is desired to exceed those limits, a BZA variance will be required, with the concomitant requirement for special circumstances and hardship.

ORDINANCE D-2005

[Adopted as Ordinance 4-2005]

COMPREHENSIVE AMENDMENT TO CHAPTER 183 "INCOME TAX" OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS AND DECLARING AN EMERGENCY.

These changes bring the Village's tax code into compliance with the requirements of Ohio House Bill 95 PDF . Among other things, the local income tax filing date is now 15 April, starting tax year 2004 (this year's filing date is 15 April 2005, not 30 April).

ORDINANCE E-2005

[Adopted as Ordinance 5-2005]

AN ORDINANCE REPEALING CHAPTER 715 "TEMPORARY SIGN ORDINANCE" OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS AND DECLARING AN EMERGENCY.

This ordinance has been incorporated into the new sign regulations; see Ordinance 3-2005 amending the Zoning Code, and Ordinance 6-2005 amending the Building Code.

ORDINANCE F-2005

[Adopted as Ordinance 6-2005]

AN ORDINANCE AMENDING CHAPTER 1385.09 OF THE BUILDING CODE TO REPEAL THE CURRENT CHAPTER IN ITS ENTIRETY AND ADOPT A NEW CHAPTER 1385.09 ENTITLED "SIGN CONSTRUCTION AND MAINTENANCE" AND DECLARING AN EMERGENCY.

This amendment to the Building Code coördinates with Ordinance 3-2005, which amends the Zoning Code to provide sign regulations.

RESOLUTION A-2005

[Adopted as Resolution 1-2005]

A RESOLUTION ACCEPTING THE FINANCIAL STATEMENTS OF THE VILLAGE OF BOSTON HEIGHTS FOR THE MONTH OF NOVEMBER, 2004.

There was no mention of who on Council, if anyone, had actually reviewed the various financial statements.

RESOLUTION B-2005

[Adopted as Resolution 2-2005]

A RESOLUTION ELECTING PRESIDENT PRO TEMPORE OF THE COUNSEL COUNCIL FOR THE VILLAGE OF BOSTON HEIGHTS.

Mr. Bela "Bill" Goncy was re-elected President Pro Tempore of Council. Mr. Goncy abstained from the otherwise unanimous vote.

RESOLUTION C-2005

A RESOLUTION DESIGNATING MEMBERS OF COUNCIL TO THE VARIOUS COMMITTEES FOR THE YEAR 2005.

Committee assignments are:

RESOLUTION D-2005

[Adopted as Resolution 4-2005]

A RESOLUTION PROVIDING FOR THE EMPLOYMENT OF OFFICIALS AND CERTAIN EMPLOYEES OF THE VILLAGE OF BOSTON HEIGHTS FOR THE YEAR 2005.

There are no changes to the village staff this year. The employees and officials are:

  • Electrical Inspector: Richard Donley (backup: Ronald Marusiak)
  • Village Engineer: Adache Cuini Lynn Associates (assigned to Steve Scheiber)
  • Cemetery Sexton: Jim Robinson
  • Clerk of Mayor's Court: Maryann Bode
  • Assistant Office Clerk: Darlene Thompson
  • "part-time help" for Clerk-Treasurer: Kathy Riedel
  • Class I,II,II Building Inspector and Plans Examiner: Ron Marusiak
  • Backup Building Inspector: Russ Rodic
  • Zoning Inspector: David Himes

The ordinance allows for termination of the Village Engineer or any inspectors if their rates increase during 2004.

RESOLUTION E-2005

[Adopted as Resolution 5-2005]

A RESOLUTION APPOINTING ED FETKO TO THE BOARD OF ZONING APPEALS FOR THE VILLAGE OF BOSTON HEIGHTS.

Mr. Fetko, of Meadowridge Way in Ashbrooke West, has served on the BZA for a number of years; Mayor McFall has re-appointed him for another term.

COMMITTEE REPORTS

Council President (Pro Tempore) Bill Goncy stated that he had reviewed the Mayor's Court reconciliation statement for November and December 2004.


Mr. Goncy reported that the Village had hosted a meeting of representatives to the Summit County Stormwater Management Program, at the Village Hall on Thursday 16 December 2004. The group of about 30 people discussed public education efforts associated with Phase II of the Program. This will likely result in a mailing to village residents later in the year.


Mr. Goncy also reported on the recent Route 8 Marginal Road Stakeholders meeting sponsored monthly by the County Engineer. That group had accepted a "Purpose and Needs" document, intended to describe the project to potential funding agencies. The needs for initial funding had also discussed, as possible Federal funding, for environmental and feasibility studies, may not materialize for a while. The County Engineer may approach affected municipalities and landowners for funding.


Councilor Mike Cheung reported on the Planning Commission meeting of 5 January 2005: no official business was transacted at that meeting. The next PC/BZA meeting is 2 February 2005 at 7PM. Dr. Cheung was reminded that the PC/BZA had a deferred application for a large elevated sign at Liberty Harley-Davidson pending the newly-enacted sign regulations.
Mayor Ray McFall mentioned that he expected Omni Realty to come back to the Village with another development plan in February or March, 2005.


Councilor Annette Miller remarked that she was pleased to see the old Yankee Clipper hotel finally demolished. Mayor McFall saluted Mr. Ernie Passeos in the audience for his assistance in accomplishing this. Mr. Passeos is owner of Liberty Harley-Davidson, adjacent to the hotel site, and reportedly a partner in the ownership of that site.


Engineer Steve Schreiber reported that he and other Village officials would be meeting with ODOT, on Thursday 15 January 2005, to discuss the projected repairs to the Akron-Cleveland Road bridge. Mr. Schreiber noted an immediate problem in that the Federal government would not increase its proposed contribution to the project, despite escalating costs as plans were firmed up. He also reported that the Village was working on "schemes" to eke another 5-6 years of life out of the bridge at a cost of $40K-60K.
