PLEDGE OF ALLEGIANCE
MINUTES PRESENTED FOR CHANGE, CORRECTION OR ADOPTION
Minutes of the October and November 2004 meetings were approved.
Solicitor Russ Pry mentioned that the Village had filed several legal motions, including:
"VBH vs. J. Michael Krieger"
concerning land use on Chittenden Rd.;
vs. Mr. Cerny on Chittenden Road;
vs. Mr. Brumfield on Olde Eight Road
(see "Motion to show cause why defendant should not be found in contempt");
and more.
Mr. Pry also offered his congratulations to his fellow Democrats in attendance: Mr. Nick Kostandaras, newly-elected County Council representative, and just re-elected Judge Carol J. Dezso.
Engineer Steve Schreiber suggested that Council send a copy of its Resolution 41-2004 to the County Engineer and ODOT. This resolution calls for the Summit County Engineer to complete the engineering design of the refurbishment of the Akron-Cleveland Road bridge over the Bike-and-Hike Trail, at the south end of the Village. This project is designated SUM CR 16-1.95 by the county.
Mayor Ray McFall mentioned that the Omni Hotel (Days Inn, Hudson Inn, Yankee Clipper) was finally being demolished. The lower parts of the hotel were already gone, and the high-rise portion should be attacked later in the week.
Mr. Nick Kostandaras (D-1), newly-elected County Council representative for District 1, thanked all his supporters in Boston Heights, and especially Mayor Ray McFall. He asked that any issue of local interest be brought to his attention at County Council, and anticipated holding quarterly meetings with the leaders in his District 1, Northern Summit County. Mr. Kostandaras also briefly mentioned the opposition of local communities to Ohio H.B. 175 (which would impose a state-wide residential building code). He also took a jab at State Senator Kevin Coughlin (R-27), who reportedly would not return his calls on this issue.
Jane Robinson, of Olde Eight Road, thanks Village safety forces for their quick response to downed electrical wires during a recent windstorm. She also inquired after trash pickup quotes; see New Business, below.
Bill Hinkle, of Boston Mills Road, asked whether Engineer Steve Schreiber had received any reply to his inquiry to ODOT about the results of the Route 8 Value Engineering study. Mr. Schreiber said: no, but he might have a reply by the end of the year.

A RESOLUTION APPOINTING KATHI COLE TO THE INCOME TAX REVIEW BOARD OF THE VILLAGE OF BOSTON HEIGHTS. Ms. Kathleen Cole, of 7470 Brandywine Road, is a 10-year resident of the Village (at least). She replaces Ms. Joleen Persichini on this board, which meets (rarely) to consider appeals and penalties relating to enforcement of the village's income tax. The board consists of Mayor Ray McFall, sitting as its chairman, and two citizens -- Mr. Robert Riedel and Ms. Cole. The board is advised by Clerk-Treasurer Carol Zeman in her role of Tax Administrator for the Village. The board's meetings are not public -- not subject to Ohio's Open Meetings law. See Village Codified Ordinance 183.11. |

A RESOLUTION AUTHORIZING THE APPROPRIATE VILLAGE OFFICIAL TO ENTER INTO A CONTRACT WITH OHIO EDISON FOR ELECTRIC SERVICE FOR STREET LIGHTING IN THE VILLAGE OF BOSTON HEIGHTS. |
Councilor Mike Cheung reported on the Planning Commission and Board of Zoning Appeals meeting of 1 December 2004. There was some head-wagging over the refusal of the PC to approve the Meghan's Lane subdivision plat and improvements. The next PC/BZA meeting is 5 January 2005 at 7PM. Clerk-Treasurer Carol Zeman also confirmed that there is a Public Hearing, on the proposed Sign Regulations for the Zoning Code, scheduled for 12 January 2005 at 7:30PM -- 1/2 hour before the next Village Council meeting. (Apparently not a lot of public comment is anticipated...). In response to an inquiry from Councilor Janet Miller, Dr. Cheung explained that the BZA had deferred an application for a large elevated sign at Liberty Harley-Davidson pending the new sign regulations.
Council President (Pro Tempore) Bill Goncy stated that he had reviewed the Mayor's Court reconciliation statement for October 2004.
Engineer Steve Schreiber reported that the Village would host a meeting of the Summit County Stormwater Management Program at the Village Hall: Thursday 16 December 2004, 8AM. The public is welcome.
Councilor Janet Miller asked, once again, whether any progress had been made in forming a "police auxiliary" for the Police Department, mirroring that of the Fire Department. The answer was, once again, "no".
Clerk-Treasurer Carol Zeman opened and read the quotations for Village-wide trash removal rates, received in response to advertising authorized by Resolution 44-2004. While we do not have the exact specifications for quotation, the rates all cover "unlimited" curb-side pickup of refuse, and some kind of curb-side recycling pickup. Quarterly rates have been translated to monthly rates here:

The Mayor referred these quotations to the Council Finance Committee, and suggested that any interested vendors attend the next meeting: 21 December 2004, 7PM at the Village Hall.
