[Note: This meeting was called by Mayor McFall at the 22 Feb 2005 Finance meeting, specifically to consider the ordinance accepting the Meghan's Lane subdivision plat and street improvements. Council had declined to "suspend the rules" and dispense with the three readings otherwise required for this ordinance, both at its 9 Feb 2005 regular meeting, and at last night's 3-minute 24 Feb 2005 special meeting.]

ROLL CALL

All Council members present: Bill Goncy (President Pro Tempore), Jim Hudson, Janet Miller, Paul Palumbo, Mike Cheung and Annette Miller.
Also present: Mayor Ray McFall and Clerk-Treasurer Carol Zeman.

PLEDGE OF ALLEGIANCE

APPROVAL OF AGENDA

The agenda was amended to remove Correspondence, Audience Participation, Old Business and New Business. As Clerk-Treasurer Carol Zeman pointed out last night, by law a Special Meeting can only consider the specific matter for which the meeting was called. The amended agenda was accepted by Council.

LEGISLATION

ORDINANCE K-2005

[Adopted as Ordinance 11-2005]

AN ORDINANCE ACCEPTING AND CONFIRMING THE DEDICATION OF THE STREET IMPROVEMENT KNOWN AS MEGHAN'S LANE IN THE MEGHAN'S LANE SUBDIVISION AND DECLARING AN EMERGENCY.

See last month's regular Council meeting notes for background on this matter.
Mayor Ray McFall suggested that it was still necessary to "suspend the rules" on this third reading, in order to pass the ordinance as an emergency measure. Clerk-Treasure Carol Zeman and Councilor Mike Cheung argued that it was unnecessary, though a supermajority was still needed for passage of the ordinance itself.
Nonetheless, in the absence of the Village Solicitor, Councilor Mike Cheung moved to "suspend the rules" just in case. Councilor Jim Hudson voted "no", all other Council members voted "yes"; that motion was approved with the necessary 3/4+ vote in favor. (See ORC 731.17)
Councilor Mike Cheung then moved approval of the ordinance. Councilor Jim Hudson voted "no", all other Council members voted "yes"; that motion was approved with the necessary 2/3+ vote in favor. (See ORC 731.30)
With this approval in hand, Mr. Carse can now proceed to sell lots in the subdivision, and refinance his loans -- and, hopefully, make good on the various promises made, under bond, to the Village.
