SPECIAL COUNCIL MEETING - February 24, 2005 - 7:00 P.M.

AGENDA

[and Editor's Notes on Council Meeting.]

[Note: This meeting was called by Mayor McFall at the 22 Feb 2005 Finance meeting, specifically to consider the ordinance accepting the Meghan's Lane subdivision plat and street improvements. At its 9 Feb 2005 regular meeting, Council had declined to "suspend the rules" to dispense with the three readings otherwise required for this ordinance.]

ROLL CALL

Council members present: Bill Goncy (President Pro Tempore), Jim Hudson, Janet Miller, Paul Palumbo, and Mike Cheung. Absent: Annette Miller.
Also present: Mayor Ray McFall, Clerk-Treasurer Carol Zeman & Deputy Solicitor Ed Muse.

PLEDGE OF ALLEGIANCE

APPROVAL OF AGENDA

The agenda was amended to remove Correspondence, Audience Participation, Old Business and New Business. As Clerk-Treasurer Carol Zeman pointed out, by law a Special Meeting can only consider the specific matter for which the meeting was called. The amended agenda was accepted by Council.

LEGISLATION

ORDINANCE K-2005

[Second reading]

AN ORDINANCE ACCEPTING AND CONFIRMING THE DEDICATION OF THE STREET IMPROVEMENT KNOWN AS MEGHAN'S LANE IN THE MEGHAN'S LANE SUBDIVISION AND DECLARING AN EMERGENCY.

See last month's regular Council meeting notes for background on this matter.
Councilor Mike Cheung moved to "suspend the rules" and dispense with the final two readings of this ordinance. Councilor Jim Hudson voted "no", all other Council members present voted "yes", and in the absence of Councilor Annette Miller, the motion failed for lack of the required 75% majority of members. (See ORC 731.17)
Therefore this constituted the second reading, no action was taken, and another Special Meeting, already called for Friday 25 Feb 2005, will be held after all.

ADJOURN

Councilor Janet Miller abstained on the motion for adjournment (!). All other members voted for it, though, so Council adjourned until tomorrow...
