*[Mayor McFall and C-T Zeman noted and corrected several errors in the official minutes; the corrected version was accepted by Council. Note that one error remained uncorrected: the reference to Mrs. Persichini's appointment to the the "Tax Incentive Review Council" should have instead referenced the "Income Tax Committee Review Board". These are two different bodies.]

CORRESPONDENCE

*[C-T Carol Zeman read a letter from Stephen Craig, Mayor of Peninsula, thanking the village's safety and maintenance crews for mutual assistance during the summer flooding.]


*[Mayor McFall noted the following upcoming events:

*[Engineer Steve Schreiber reported...
... The Issue 2 Committee had evaluated the village's two applications for state funding. Out of 100 points generally required to receive funding, the Water Mains project received only 31 and the Akron-Cleveland Road Bridge replacement project received 81. Both lagged scoring for projects proposed by the City of Akron. The Engineer was able to boost the bridge's score by 2 points, though a 30 Ton Load Limit, for which the County will supply signs. He felt that funding was unlikely this year -- possible in 2004.
... Karvo Paving had established a schedule for work on the Colesbrooke Road, which would require the road to be completely closed on either 23 October or 24 October as a rain-date. The Ashbrooke West Homeowners Association had been notified of the closure, as would the school systems, trash companies, Post Office, and emergency services. The contractor is intending to make this a fast-track project for minimal road downtime.
... Two new subdivisions would shortly be submitting final plans; these are Annabelle Lake Estates (on Walters Road) and Donley Farms (on Olde 8). The Engineer has asked Solicitor Russ Pry to prepare more specific rules for approval of subdivision plans.
... The Olde 8 Road resurfacing project had developed a couple of problems. One is that previous crack sealing materials had interacted poorly with the new pavement, causing some new cracking. Karvo Paving had agreed to provide an additional year of crack sealing, for a total of two years. There had also been a discrepency in the materials in that the asphalt mix used gravel instead of slag; upon investigation, Mr. Schreiber found that this had not resulted in use of inferior materials, albeit different than that specified in the original bid package.
... He had determined that the Village could likely get 90% funding for a complete replacement of Olde 8 pavement, but that since this was a $3.5M job, the Village would still be hard-pressed to come up with the remaining 10% anytime in the near future.

AUDIENCE PARTICIPATION

*[Ms. Joani Hedderick, of Colesbrooke Drive, briefly reviewed the Colesbrooke paving schedule with Engineer Schreiber. Mr. Schreiber reminded her of still-missing work agreements.]


*[Ms. Mary Griffith, of Olde Eight, complained of the poor texture of the stone fill placed in the berms as part of the repaving project. She stated that the surface was unsuitable for pedestrian use. Mr. Schreiber was unsympathetic.]

ORDINANCE N-2003

AN ORDINANCE REGULATING UNLAWFUL NOISE AND DISTURBANCES AND AMENDING THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS TO ADD A NEW SECTION 509.12 TO THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS.

[Solicitor Russ Pry mentioned that this ordinance had received further discussion at the last Finance Committee meeting. He would be reviewing the proposed ordinance with Police Chief Joe Varga to consider enforcement issues. See also last month's discussion.]

ORDINANCE O-2003
[Approved as Ordinance 15-2003]

AN ORDINANCE AMENDING CHAPTER 139.01(A) OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS TO CREATE A NEW POSITION OF FIRST RESPONDER, AND DECLARING AN EMERGENCY.

[This creates a new job category in the Fire Department, whereby an employee can be a trained First Responder but not a full-fledged Firefighter. The First Responder program provides an early response to medical/accident emergencies in the village, generally before the regular EMS crew can arrive from Macedonia.]

ORDINANCE P-2003
[Approved as Ordinance 16-2003]

AN ORDINANCE AMENDING ORDINANCE 8-2003 REGARDING COMPENSATION FOR EMPLOYEES OF THE VILLAGE OF BOSTON HEIGHTS AND DECLARING AN EMERGENCY.

[This establishes a pay scale for the new First Responder job category, at $1 less than a full-fledged Firefighter -- at $9.30/hour.]

AN ORDINANCE AMENDING THE 2003 APPROPRIATION ORDINANCE (ORDINANCE 6-2003) AND DECLARING AN EMERGENCY.

RESOLUTION Y-2003
[Approved as Resolution 25-2003]

A RESOLUTION ACCEPTING THE AMOUNT AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY AUDITOR.

COMMITTEE REPORTS

*[Councilor Mike Cheung reported on the Planning Commission meeting of 1 October 2003, noting especially the "continuing discussion" of a commercial development proposed by Omni Realty for Hines Hill Road and Boston Mills Road, east of Route 8. He noted that the next meeting would be on 5 November 2003. Solictor Pry mentioned that he had finally received Omni's proposed zoning ordinance language, but would not distribute it before the Planning Commission had a chance to consider it. This would allow mixed uses and high-density housing in a PUD.]


*[Councilor Cheung also stated that he had reviewed the village's financial statements through 30 September 2003.]

*[Council P-PT Bill Goncy stated that he had not had time to review any further Mayor's Court reconciliations or Village bank reconciliations.]

*[Councilor Teri Slane stated that she had reviewed the Village's expenditures through September 2003.]

*[Councilor Slane also noted that the Fire Department expected to begin its First Responder program on 1 November 2003. See above, Ordinances O-2003 and P-2003.]

*[Councilor Paul Palumbo reported that the Safety 1 Committee had met and considered the Police Chief's "wish list", among other matters -- which he did not enumerate.]
