C.T. Taylor Co. Inc.
Request for sign approval.
C.T. Taylor Co. Inc. is located at 5802 Akron-Cleveland Road, a 3.91-acre parcel, #1300689.
Oddly, their website says "C.T.Taylor is located in Hudson Ohio".
This actually appeared 2nd on the meeting agenda.
The Planning Commission considered a new sign, which Zoning Inspector Ron Fenn characterized as in compliance with the codified ordinances.
Resolution:
The sign was approved on a unanimous vote of the Planning Commission.

James Hudson
Request for a variance for addition to an existing building.
James D. and Cynthia A. Hudson are owners of 7697 Olde 8 Road, an 0.51 parcel (66ftx330ft), #1400082.
This actually appeared 1st on the meeting agenda.
Mr. Hudson stated that he wanted to extend an existing garage parallel to the lot line, where the garage was already just 2 feet from that lot line. The zoning ordinances require 5 feet. The garage is next to a similar structure on the adjacent lot.
Resolution:
The variance was granted on a unanimous vote of the Board of Zoning Appeals.

Further consideration of suggested changes to proposed zoning ordinances.
This was to continue, and perhaps complete, the discussions and approvals of amendments to the zoning plan. A number of amendments were approved at the 04-Sep and 02-Oct meetings. Several citizens appeared at this meeting specifically for this issue.
Deputy Solicitor Ed Muse stated that there was a legal defect in the votes on these amendments, at least at the 04-Sep meeting -- only the Planning Commission votes should have been counted. PC Chairman Chuck Robinson stated that in the future, the Planning Commission and Board of Zoning Appeals would be seated separately for their sessions, to better delineate their functions, discussions and voting.
Mr. Robinson suggested that this matter be tabled until the next Planning Commission meeting, 04-Dec-2002. He noted that there were two members of the Planning Commission absent, including Dr. Mike Cheung, the architect of the new zoning plan. (Note: Councilman Bill Goncy was temporarily sitting in for Dr. Cheung).
Resolution:
The Planning Commission voted to table this matter until December.

An update on enforcement of a previous variance action.
This referred to the
September hearing on the Brumfield variance. Zoning Inspector Ron Fenn stated that he had sent a letter to Mr. Brumfield citing excess trucks on the property. Mr. Robinson noted that oversize trucks were also still present. Mrs. Robinson (a neighbor) reported from the audience that "nothing" had changed on the property since the hearing.
Deputy Solicitor Ed Muse stated that, since there appeared to still be violations of the variance after the 30 day grace period granted at the September hearing, the Village would consider whether and when to take the matter to court. Mr. Muse repeated his previous opinion that the BZA had the implicit power to rescind a variance in case of violation, but that the BZA had referred the matter to the executive (the Mayor and officers) for enforcement.
Resolution:
No further action by the Board of Zoning Appeals.
