ROLL CALL

This Council meeting was cancelled due to lack of quorum; the roll was never called.
Council members present: Bill Goncy (President Pro Tempore), Jim Hudson, and Paul Palumbo.
Absent: Mike Cheung, Janet Miller, Teri Slane. (Variously: pre-arranged absence, personal emergency, mix-up regarding meeting date or agenda.)
Also present: Mayor Ray McFall, Clerk-Treasurer Carol Zeman, Solicitor Russ Pry, and Engineer Steve Schreiber.

As permitted by the Village's ordinances, Mayor Ray McFall called for a special Council meeting to be held on Tuesday, 14 March 2006, 8PM at the Village Hall. The special Council meeting will take up the agenda of this cancelled meeting.


AUDIENCE PARTICIPATION

As a large number of citizens were present anyhow, Solicitor Russ Pry suggested that the Village officials, and those members of Council present, hear what they had to say.

Chris Gorczycki, of Parkside Court, and Kevin Lightner of Hines Hill Road, both reported that the residents of Wooded View Estates were in the process of taking over control of the subdivision's Homeowner's Association from Mr. Saffron, the original developer. It had come to the working group's attention that a large and elaborate accessory building (at 245 W. Hines Hill Road, in Wooded View) was in the process of receiving a building permit from the Village. These gentlemen pointed out that the subdivision's approved plat cited certain deed restrictions. One of the restrictions on all the Wooded View deeds reportedly requires approval of the Homeowner's Association for all accessory building (outbuildings). No such approval had been sought. Pointing out the Village Zoning Code "Conflict" clause (CO 1143.01), Mr. Gorczycki asked whether the Village would enforce such deed restrictions. Mr. Lightner asked how the Homeowner's Association could coordinate with the Village to do so itself, proactively.

Solicitor Pry responded that, while the conflict cause gave precedence to the more restrictive of code or covenants, it did not require the Village to enforce such deed restrictions. There was a great deal of further discussion, including some commentary from Zoning Inspector David Himes on the specific accessory building in question.

Finally, Mr. Pry suggested that Village could resurrect its former practice of handing out relevant Homeowners' Association documents with applications for building permits. He asked that those documents be given to the Village so that this could be worked into a permit checklist scheme. He also suggested that the (future?) president of the Wooded View Homeowner's Association ask the Village Building Department to advise on any relevant building permit applications.
