1143.01 INTERPRETATION, PURPOSE AND CONFLICT.

In interpreting and applying the provisions of this Zoning Ordinance, they shall be held to be the minimum requirements for the promotion of the public health, safety, morals, comfort and general welfare. Wherever the regulations of this Zoning Ordinance require a greater width or size of yard or other open spaces or require a lower height of building or less number of stories or require a greater percentage of lot to be left unoccupied or require a lower density of population, or require a more restricted use of land, or impose other higher standards than are required in any other ordinance or regulation, private deed restriction or private covenant, these regulations shall govern, but if the requirements of the other ordinance, regulation, private deed restriction or private covenant is the more restrictive, then those requirements shall govern.

1143.02 ENFORCEMENT.

This Zoning Ordinance shall be enforced by the Zoning Inspector under the rules and regulations of the Board of Zoning Appeals and by such other officer or officers as may be designated by State law to enforce municipal laws and regulations. The Zoning Inspector shall be appointed by the Mayor with the approval of Council.

1143.03 AMENDMENT PROCEDURE.

(a) Council may, from time to time, upon its own motion or on petition, after public notice and hearing, amend or change the regulations, districts or building lines as established by the Zoning Ordinance or any amendments thereto, but no such amendment or change shall be effective unless the ordinance or petition proposing such amendment or change is first submitted to the Planning Commission for approval, disapproval, or suggestions, and the Planning Commission shall have been allowed a reasonable time, not less than thirty days for consideration and report.

 

(b) Whenever the owners of fifty percent (50%) or more of the land in any area sought to be rezoned present a petition, duly signed and acknowledged, to Council requesting an amendment of the regulations prescribed for such area, it shall be the duty of Council to vote upon such amendment within ninety days, of the filing of the same by the petitioners with the Clerk-Treasurer.

1143.04 VALIDITY.

If any section, paragraph, subdivision, clause, phrase or provision of this Zoning Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Zoning Ordinance as a whole or any part or provision thereof other than the part so decided to be invalid or unconstitutional.

1143.05 EFFECTIVE DATE.

Upon its final passage, this Zoning Ordinance shall be in full force and effect at the earliest date allowed by law.

1143.99 PENALTY.

Any person, firm or corporation who violates any provision of this Zoning Ordinance shall be fined not less than five hundred dollars ($500.00) nor more than one thousand dollars ($1,000). Every day during which such violation continues shall constitute a separate offense.
