ORDINANCE M-2002

AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING PLAN
CONTAINED IN THE CODIFIED ORDINANCES OF THE
VILLAGE OF BOSTON HEIGHTS.

WHEREAS, the Planning Commission of the Village of Boston Heights pursuant to Ohio Revised Code Section 713.01 et seq. and more specifically Section 713.07, has certified to the Council of the Village of Boston Heights a plan for the amendment of the Comprehensive Zoning Plan.

WHEREAS, in order to effectuate said plan Chapters 1151, 1153, 1157, 1159 and 1161 of the Codified Ordinances of the Village of Boston Heights must be repealed.

NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Boston Heights, County of Summit and State of Ohio:

Section 1: Chapters 1151, 1153, 1157, 1159 and 1161 of the Codified Ordinances of the Village of Boston Heights are hereby repealed in their entirety and shall be replaced with an alternative comprehensive zoning plan as is more fully set forth in Exhibit A attached hereto and made a part hereof by reference.

Section 2: The Zoning Classification Map attached hereto as Exhibit B is hereby accepted by Council.

Section 3: Any chapter of the Codified Ordinances of the Village of Boston Heights which refers to a zoning district which has been repealed by this Ordinance shall now be read to refer to the new districts created herein as follows:

R-1 is now Residential District

RR is now Recreation District

B-1 is now General Business District and/or Retail Business District

O-1 is now Office/Professional District

I-1 is now Light Manufacturing District

Section 4: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of Council and that all deliberations of this Council and of any of its committees or subcommittees that resulted in those formal actions were in meetings open to the public in compliance with the Law.

Section 5: This Ordinance was duly adopted and shall take effect thirty (30) days after its adoption by Council and approval by the Mayor, otherwise, at the earliest period allowed by law.
