[Note: this Special Council Meeting was inserted into a recess in the regular Finance Committee meeting of 28 July 2004. Both of the items introduced and approved appear to be related to the Village's budget difficulties, revealed at the Special Finance Committee meeting of 20 July 2004.
There was absolutely no discussion of, or explanation given for, this legislation, nor when and where the (presumable) deliberations took place.]

ORDINANCE O-2004

AN ORDINANCE AMENDING CHAPTER 181.11 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS ENTITLED "DISBURSEMENTS OF RECEIPTS" AND DECLARING AN EMERGENCY.

This item amends the Hotel Transient Guest Tax ("Bed Tax") ordinance to kill Codified Ordinances 181.11(c) and (d). These are the provisions that finance the Boston Heights Matthew-Thomas Park with the first $10,000 from the 2nd and 3rd quarter of each year. The tax is remitted by each hotel the beginning of the following quarter. The provisions for the 1st (b) and 4th (a) quarters were left intact: all of the 4th quarter tax goes to the General Fund; of the 1st quarter tax, the first $5,000 goes to the Park and the rest to the General Fund. In the absence of any replacement language, it appears that the first $5,000 of the 2nd quarter will go to the Park and all the rest of the year's receipts will now go to the General Fund.
This was introduced as an emergency measure, and so goes into effect immediately. (This originally appeared on the Agenda, and was voted on, as Ordinance N-2004 -- but it was later pointed out that N-2004 had already been used at the previous Council meeting.)

RESOLUTION EE-2004

[Approved as Resolution 32-2004]

A RESOLUTION AUTHORIZING THE VILLAGE OF BOSTON HEIGHTS, OHIO TO ISSUE A GENERAL OBLIGATION NOTE IN THE AMOUNT OF ONE HUNDRED THOUSAND DOLLARS ($100,000.00).

This amounts to about 8% of the Village's annual budget. The purpose of this note was not explained other than by the Resolution's "whereas's": "the Village... has suffered an unexpected decrease in revenues and has taken appropriate measures to address the revenue shortage; the Village... is in need of additional funds."
Possibly it is intended as a sort of bridge loan to alleviate an immediate cash-flow problem, to be collateralized by the Village's expected tax receipts later in the year. If your editor finds out more, it will be added here.
