ROLL CALL

Council members present: Bill Goncy (President Pro Tempore), Mike Cheung, Jim Hudson, Annette Miller, Paul Palumbo, and Janet Miller.
Also present: Mayor Ray McFall, Clerk-Treasurer Carol Zeman, Solicitor Russ Pry, and Engineer Steve Schreiber.

MINUTES PRESENTED FOR CHANGE, CORRECTION OR ADOPTION

Minutes of the October 2005 meeting were corrected and approved.


CORRESPONDENCE

Mayor Ray McFall offered his congratulations to "Bill, Mike, Jim and Teri" on their (re-)election to Village Council at yesterday's election. (Note: they are Bill (Bela) Goncy, H. Michael Cheung, James Hudson and Teresa Slane; Councilor Annette Miller, whose term expires with 2005, did not stand for re-election). The Mayor also mentioned the Park Board's Senior Dinner on 19 November, and Santa Delivery on 18 December (deadline for dropping off wrapped gifts at the Village Hall: Thursday, 15 December).


AUDIENCE PARTICIPATION

Joe R___, of 300 Parkside Court in Wooded View Estates, asked that Village Engineer Steve Schreiber put in writing an agreement or plan that had been discussed with the Village. Mr. R____ did not elucidate; however, this appeared to be related to a drainage matter brought up by the same gentleman at last month's Council meeting. Mr. R___ also complained about his name appearing on this website, stating that he considered his comments at these public meetings to be entirely between himself and the Village Council. Mr. Hinkle, the editor of this website, offered to discuss the matter after the meeting.


LEGISLATION

ORDINANCE X-2005

[Adopted as Ord. 25-2005]

AN ORDINANCE AMENDING CHAPTERS 141.01 AND 141.02 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS RENAMING THE STREET COMMISSIONER TO ROAD DEPARTMENT SUPERINTENDENT, ADJUSTING THE GENERAL DUTIES AND DECLARING AN EMERGENCY.

This ordinance has been in and out of committee for several months; the intention is apparently to formalize the division of duties between the Street Commissioner (now Jim Robinson) and the Village Engineer (now Steve Schreiber of ACLA). For further information, see notes on the the meetings of September 2005 and October 2005.

ORDINANCE Y-2005

[Adopted as Ord. 26-2005]

AN ORDINANCE AMENDING CHAPTER 143 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS TO CLARIFY THE DUTIES OF THE VILLAGE ENGINEER AND DECLARING AN EMERGENCY.

ORDINANCE BB-2005

[First Reading]

AN ORDINANCE ENTERING INTO AN AGREEMENT WITH THE STATE OF OHIO FOR IMPROVEMENTS TO STATE ROUTE 8 AND DECLARING AN EMERGENCY.

This item was tabled and referred to the Finance Committee. This does not appear to refer to the planned upgrade of Route 8; the resolution refers to "Major rehabilitation from the Southest corporation limits of Village to just North of SR303 (Streetsboro Road)". This section of Route 8 is already a modern limited-access highway. The resolution would appear to make the Village (not ODOT) solely responsible for all "unnecessary" costs for features requested by the Village, and for maintenance of the "described project". However, the project itself is not described at all, which may be Council's concern. It is possible that this project is the proposed traffic signal at the foot of the northbound exit ramp from Route 8 at Route 303.

RESOLUTION LL-2005

[Adopted as Resolution 36-2005]

A RESOLUTION AUTHORIZING THE VILLAGE OFFICIALS TO ENGAGE IN CONTRACT NEGOTIATIONS WITH THEODORE G. MANFRASS, AIA, ARCHITECTS AND PLANNERS, INC., FOR ARCHITECTURAL SERVICES FOR THE ADDITION TO THE VILLAGE'S FIRE DEPARTMENT.

Council President Pro Tem. Bill Goncy voted against this resolution. In several earlier Finance Committee meetings, Mr. Goncy has expressed some reservations about the planning for this addition. It is expected to add office, meeting and storage space to the Fire Station.

RESOLUTION MM-2005

[Adopted as Resolution 37-2005]

A RESOLUTION ACCEPTING THE FINANCIAL STATEMENTS OF THE VILLAGE OF BOSTON HEIGHTS FOR THE MONTH OF SEPTEMBER, 2005.

Councilor Janet Miller pointed out an apparent error in the dating of a cash balance on one of these reports; Clerk-Treasurer Carol Zeman said she would make the correction.

RESOLUTION NN-2005

[Adopted as Resolution 38-2005]

A RESOLUTION DECLARING KARVO PAVING IN DEFAULT OF A PUBLIC CONTRACT AND AUTHORIZING VILLAGE OFFICIALS TO USE RETAINED FUNDS TO COMPLETE THE CONTRACT.

This resolution refers to Karvo's alleged refusal to complete the crack sealing maintenance that was part of their earlier contract to repave Olde Eight Road.

RESOLUTION OO-2005

[Adopted as Resolution 39-2005]

A RESOLUTION AUTHORIZING THE MAYOR AND CLERK-TREASURER TO ENTER INTO AN EMERGENCY CONTRACT FOR THE VILLAGE'S SEPTIC SYSTEM IN ACCORDANCE WITH O.R.C. 735.051.

At the October Finance Committee meeting, Engineer Schreiber noted that he was having trouble finding a contractor that wanted to tackle this job. The Village has a time-limited EPA permit to install a new septic system for the entire Village Hall complex, including the Police and Fire Stations.

COMMITTEE REPORTS

Councilor Mike Cheung reviewed the actions of the the Planning Commission meeting of 2 November 2005. He listed site plan approvals for Lorillard Tobacco and Air Power of Ohio, as well as sign approvals for the latter. He also noted that the Planning Commission had deferred the application for new zoning ordinances to permit a proposed development of the Boston Hills Country Club. The next PC/BZA meeting will be Wednesday, 7 December 2005, 7PM at the Village Hall.


Council President (Pro Tempore) Bill Goncy stated that he had reviewed the Mayor's Court bank reconciliation for September 2005. He also reported on a number of regional meetings and activities:


Mr. Goncy said he had attended a meeting for the Storm Water Management Program on the topic of "Low Impact Development" which he felt was similar to the "Conservation Development Zoning" touted by representatives of the Cuyahoga Valley National Park, at the recent Planning Commission meeting.


Mr. Goncy also attended an AMATS meeting, wherein nothing new transpired that was directly related to the Village of Boston Heights.


Mr. Goncy mentioned the recent Strategic Planning meeting held here by the Hudson City School District. He pointed out that there was no discussion of school district boundaries; the district is soliciting volunteers to work on various strategic planning committees.


Mr. Goncy reported that there had been no meeting of the Route 8 Marginal Road Stakeholders this month.


Councilor Jim Hudson relayed the Road Department report on the usual maintenance and repair tasks. Mr. Hudson also reported that the Road Committee had met to consider the ongoing question of enclosure of ditches and drains. The concensus of the committee was to maintain the current policy of requiring open ditches and swales, noting, however, that the handling of special cases requires further discussion with the Village Engineer -- that is, situations where existing drainage schemes have some negative impact.


Councilor Paul Palumbo reported that the Safety 1 (Police) Committee had met and discussed the question of a separate Police Levy, and formation of a Police Association.


Village Engineer Steve Schreiber reported that the bonds had been released for John Carse's Meghan's Lane housing development. The bonds had been posted to ensure compliance with the Village's development requirements. He noted, however, that the developer was proceeding with landscaping work that he was not sure had been approved; he thought "someone" should check on it. He also added that no gas mains had yet been installed in this development -- which had, a few months ago, appeared to be something of a surprise to the Village's officials. Mr. Schreiber also reported that he felt he had a solution to "Mr. R____'s" drainage problem, as mentioned earlier.
