*[Clerk-Treasurer Carol Zeman announced that the Akron-Summit County Public Library had requested an opportunity to speak, at the February 2004 Council Meeting, on its operating levy that will appear on the March 2004 ballot. At that same meeting, Mr. Pruitt from the Summit County Health Department will speak on the upcoming septic tank maintenance plan (which includes a $35/year fee).]
*["Marge" noted that the issue of income tax collection had arised during last
November's election. (C-T candidate Joani Heddericks has proposed having the village do its
own income tax collection, rather than paying RITA to do it).
Clerk-Treasurer Zeman explained that RITA was paid, last year, about $10,100 to collect
about $340,000 in taxes for the village. She stated that this was "not excessive"
given the high overhead required to bring the process in-house. For instance, she expected
the personnel costs alone to exceed the RITA fees (e.g. wages, benefits). She also noted
that the village had very little available storage space (in the basement), and little of it
secure enough for income tax records -- even if reduced
to microfiche. In summary,
she felt that RITA's efficiencies of scale would make their costs lower than what the village
could accomplish on its own. From the audience, Mrs. David Himes noted some supporting details,
and Mr. Hinkle pointed out that RITA's forms were
already handled by personal income tax software.]
*[Mr. Mike Bush, resident of Colesbrooke Dr. and president of the Ashbrooke West Homeowner's Association,
expressed concern about an address numbering sign recently erected by the village in his
neighborhood. While he understood the desire to improve emergency response, he noted that the
sign at Colesbrook and Norbury was in error because the house numbering on Colesbrooke is so
scrambled. Mayor Ray McFall said he would have the Road Superintendent look into fixing the sign.]
*[Mr. William Hinkle, of Boston Mills Road (and editor of these notes), asked Mrs. Zeman
whether he had understood correctly, from a recent meeting, that the Holiday Inn on Route 8
had never paid the village's admission tax. C-T Zeman replied that this was correct, but that
it was not the responsibility of the Holiday Inn to collect or remit that tax for organizers
of events in their facility. Mr. Hinkle noted a recent advertisement in the Hudson Hub-Times
that specifically referred to an "admission fee" for an event at the hotel (an
antiques show). He asked whether, then, any such organizers had ever remitted the tax.
Mrs. Zeman replied that they had not, but that the tax was certainly due in such cases,
and she would re-instruct the hotel to explain the tax collection requirement to their event
organizers. (Note: the same question, with no resolution, has repeatedly arisen about paid events at the
National Park's Happy Days Visitors Center.]

AN ORDINANCE TO ADOPT 2004 AMENDMENTS TO THE TRAFFIC AND GENERAL OFFENSES CODES AND DECLARING AN EMERGENCY. [Solicitor Russ Pry has previously explained that this was a measure required to bring the village's ordinances (Parts 3 and 5) into conformance with changes to state law. In particular, see Senate Bill 123, which revised the traffic code, and House Bill 490, which raises the fine for a minor misdemeanor to $150.] |

AN ORDINANCE AMENDING THE 2003 ANNUAL APPROPRIATION ORDINANCE (ORDINANCE 6-2003) TO AUTHORIZE THE EXPENDITURE OF SUMS FROM THE CONTINGENCY APPROPRIATION AND DECLARING AN EMERGENCY. [Councilor Mike Cheung asked for the amount of this expenditure. C-T Zeman stated that it was $40,000. This transfer is for additional salary expenses during 2003. The original contingency appropriation for 2003 was $63,407.26.] |

A RESOLUTION COMMENDING COUNCIL WOMAN TERI SLANE FOR HER YEARS OF DEDICATED SERVICE TO THE VILLAGE OF BOSTON HEIGHTS, OHIO. [Ms. Slane received a round of applause from the audience and Council. Ms. Slane had opted to run for Mayor in the past election rather than attempt to retain her council seat.] |
*[Councilor Mike Cheung reported on the Planning Commission
and Board of Zoning Appeals meeting of 7 January 2004. He noted that the next meeting would
be on 4 February 2004, and that meetings would continue to be on the first Wednesday of each month.]
*[Councilor Cheung stated that he had reviewed the Village's financial statements through
the end of December2003.]
*[NOTE: Previously, former Councilor Terry Slane had reviewed the Village's expenditures
monthly. No one reported such a review for December 2004.]
*[Council P-PT Bill Goncy stated that he had reviewed the Village's bank reconciliations
and the Mayor's Court bank reconciliations for October, November and December 2003.]
*[Councilor Jim Hudson reported the usual doings of the village's Road Department.]
*[Councilor Janet Miller reported on the Safety 2 (Fire) Committee meeting.
The committee reviewed the Fire Department's wants and needs with
Fire Chief Jim Robinson, and asked him to submit a 5-year plan.]
*[Councilor Paul Palumbo reported that Park Board had met and would be submitting some
(unexplained) matters to the Council Finance Committee.]
*[Engineer Steve Schreiber noted that he had contacted by
GPB Group in connection with
their start on the final design of the Route 8 upgrade project through Boston Heights.
Mr. Schreiber also reported that the EPA would be conducting a site inspection at the village
hall complex, in connection with the village's application for a single replacement
septic system.]
*[Solictor Russ Pry noted that a meeting would take place at 10AM, 15 January 2004 at the
Village Hall, to address alleged violations of zoning and other ordinances on the Cerny
property on Chittenden Road.]
*[Clerk-Treasurer Carol Zeman reported that the village was looking into reduced prices for
village trash pickup, particularly for elderly residents.]
