[All council members were present, except Mr. Jim Hudson; also present were Mayor Ray McFall, Clerk/Treasurer Carol Zeman, Engineer Steve Schreiber, & Solicitor Russ Pry.]

*[The Clerk/Treasurer noted that the next deadline for filing application for the 2.5% residential property tax reduction is June 1st, 2002. The forms can be had from the Village Hall, or click here to download "Application for 2½% Percent Tax Reduction" form and print it yourself. There is an additional tax reduction for homeowners 65+ or disabled too: click here to download "Homestead Exemption" form.]


*[The Engineer noted that he had contacted Northern Ohio Paving to arrange for them to complete crack sealing and other repairs on the newly-repaved stretch of Olde 8 Road. He further noted that he is working for plans for the new handicap-accessible restrooms to be built onto the Village Hall, and that there were platting issues that needed to be resolved first.]

*[The Solicitor passed out to Council a (preliminary?) ordinance version of the
proposed new Village Zoning Plan. He suggested that the upcoming Public Hearing on June 5th 2002 be made a "special council meeting" to ensure that all of the Village Council was present during the meeting, given that the Plan is a major change and update to long-standing Village land use plan. Dr. Cheung inquired as to whether this would really be necessary, as the Public Hearing was intended to be advisory to the Planning Commission in formulating its recommendation to Council. The concern seemed (to your editor) to be to avoid the appearance of this Plan being steamrollered through with only a cursory nod to citizen input. The Solicitor underscored his original suggestion, suggesting that this would dot some legal i's and cross some t's.]


*[The Solicitor further noted (in response to some State or County correspondence to the Village, apparently) that the Village's "Tax Incentive Review Council" must meet to review tax abatements granted in the Western Reserve Enterprise Zone. Since the Village did not yet have such a body, it must be formed and scheduled for a meeting, as the Village now has one such
tax abatement: the McLean Company on Chittenden Road. He noted that this council must consist of the following, or their designees: the Mayor, a member of Council (designated by P-PT of Council), Clerk/Treasurer, County Auditor, representative of (Hudson) School District, and two citizens appointed by the Mayor. The body would meet in what amounts to executive session, not a public meeting subject to the Ohio Sunshine Law, as the company (-ies) in question must present proprietary business information.]


*[Mayor McFall noted that Memorial Day services would be conducted at Fairview cemetery on May 27, 2000. He also stated that the annual Fire Department steak dinner and raffle would be held at the Fire Station on May 18th -- tickets for both available at the Village Hall.]


AUDIENCE PARTICIPATION

*[Visiting politicos Tom Bevan, running for State Senate (D-27) and Kurt Landefeld, running for State Representative (D-45), spoke briefly on a number of topics. First was to wryly acknowledge their respective victories in the previous day's uncontested Democrat primary.
Mr. Landefeld noted that Boston Township was wrestling with an additional taking of three residential properties by the Cuyahoga Valley National Park, thus removing them from the tax rolls. He suggested that the village's representatives to the
Cuyahoga Valley Communities Council be aware of this issue during future meetings. After a brief bout of head-scratching, it was determined that those representatives are P-PT Bela Goncy and Councilor Annette Miller.
Mr. Landefeld further noted that he had sent a "strongly worded letter" to the ODOT, objecting to the currents plans for "upgrading" State Route 8, and had received no reply from Mr. M. Darwesh (or anyone else, apparently).



*[Sara Fenderbosch, of Rainbowers Gallery on Olde 8 Road, spoke on two topics. First, she noted her concern about the proposed new Zoning Plan, especially given the apparent possible rezoning of part of her property from B-1 to RES. (Dr. Cheung had noted in an unofficial aside that this was a preliminary idea to evoke comments and suggestions from the property owners and citizens, not a done deal). Ms. Fenderbosch further stated her concern and objection to what is apparently a long-running nuisance use of the property adjoining hers. She stated that the property was being improperly used for industrial purposes, and asked what the Village would do about it. The Mayor and Solicitor replied that the property owner in question, one Mr. Brumfield, had been previously cited by the Zoning Inspector and in fact had been taken to court by the Village, and apparently ordered to desist -- all this "last year". Ms. F. stated that the nuisance use had resumed. Dr. Cheung noted that Council could do nothing, as the powers of enforcement were not in its purview -- glancing significantly at the Mayor. The Mayor stated that the Zoning Inspector would have to re-examine the situation and possible cite the property owner again. Ms. F. made plain her desire that something be done, as the situation was adversely effecting her enjoyment of her property.]

*[Another citizen, unidentified, offered her appreciation and thanks to the Village Police Department for keeping an eye on her home during a recent absence. The Mayor stated that the officers generally do a good job of watching out for this sort of situation.]

AN ORDINANCE CREATING A NEW CHAPTER 1503 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF BOSTON HEIGHTS ENTITLED "RAPID ENTRY SYSTEM".

THIRD READING
[The Village Solicitor had noted, at earlier meetings, that this was intended to establish a new system for commercial buildings to allow access for firefighting, using a key lockbox.]

ORDINANCE L-2002
[First Reading]
AN ORDINANCE DECLARING THE GYPSY MOTH A NUISANCE.
[The Village Solicitor noted that all gypsy moths would have an opportunity to make any objections, as there would be three readings of this proposed ordinance.]
RESOLUTION H-2002
[passed as Resolution 8-2002]
A RESOLUTION APPROVING AND RATIFYING THE CONTRACT WITH THE SUMMIT COUNTY PUBLIC DEFENDER'S OFFICE.
[C/T Zeman noted that the Village currently and will continue to pay $150 per case, where there is the possibility of jail time for indigent defendants.]

COMMITTEE REPORTS

*[Councilor Cheung stated that the Planning Commission/BOZ had met and heard proposals for a senior development at the Papes Farm site on Hines Hill Road, and an office/retail development on Hines Hill Road S.E. of State Route 8. Mr. Greg Baka of Omni Development spoke on the latter topic, which was still preliminary. Dr. Cheung noted again the public hearing on June 5th for consideration of the current Draft Rezoning Proposal.]



*[Council P-PT Goncy stated that he had reviewed the monthly bank reconciliations available to date. Councilor Slane stated the same concerning monthly expenditures. She further noted that there were issues with the cemetery that would be discussed at the next pertinent committee meeting.]


*[Councilor Cheung also stated that he had reviewed the Village financial statements available to date.]

*[Councilor Palumbo noted that a member of the Police Auxiliary had resigned and asked that candidates step forward. Chief Varga spoke from the audience to note that three more members of the Auxiliary were expected to also resign within the month, leaving four vacancies -- and that this would put a crimp in the activities of the Police Department.]

NEW BUSINESS

*[The Mayor proceeded to form the above-mentioned Tax Incentive Review Council. He stated that he would serve, as did C/T Zeman and P-PT Goncy. He appointed Bill Hinkle (your editor) and Jim Bragg, both present in the audience, as the citizen members of this body. The Solicitor stated that he would contact the County Auditor and Hudson School District, as well as McLean Company, to provide representation. The necessary meeting was set for May 22nd 2002 at 7:30PM.]
